Dino Jiu Jitsu Participation Waiver

WARNING, WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND AGREEMENT TO PARTICIPATE

THIS AGREEMENT IS REQUIRED FOR ALL MEMBERS WISHING TO ENGAGE IN ACTIVITIES AT DINO JIU JITSU.

In consideration of my engagement in any form or participation at Dino Jiu Jitsu:

Acknowledgment and Assumption of Risk:
I, the undersigned Participant, and/or the Parent/Guardian of the Participant if under 18 years old, hereby acknowledge that participation in Brazilian Jiu-Jitsu, grappling, self-defense classes, and other related physical activities (collectively, the "Activities") offered by Dino BJJ LLC located in Texas, involves inherent risks of physical injury, including but not limited to bruises, strains, sprains, fractures, dislocations, and other serious or potentially fatal injuries. I understand and voluntarily accept these risks for myself or for my minor child.

Health and Safety:
I affirm that I, or my minor child, am in good physical condition and do not suffer from any known disability or condition which would prevent or limit participation in the Activities. I agree to inform Dino BJJ LLC immediately of any health changes or conditions that may affect my or my minor child’s ability to participate in the Activities.

Release and Waiver of Claims:
In consideration of being allowed to participate in the Activities, I hereby release, waive, discharge, and covenant not to sue Dino BJJ LLC, its affiliates, members, managers, employees, agents, and instructors (collectively, "Released Parties") from any and all claims, liabilities, damages, or demands arising out of or related to any injury, disability, death, or loss or damage to person or property, whether arising from the negligence of the Released Parties or otherwise, to the fullest extent permitted by Texas law.

Indemnification:
I agree to indemnify and hold harmless the Released Parties from any and all claims, actions, suits, costs, expenses, damages, and liabilities, including attorney’s fees, arising out of or in any way related to my or my minor child’s participation in the Activities.

Photography/Video Release:
I grant Dino BJJ LLC permission to photograph or video record me or my minor child during Activities for use in promotional materials, social media, and other business-related purposes. I waive any right to inspect or approve the finished product and acknowledge that I am not entitled to any compensation for such use.

Governing Law and Jurisdiction:
This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. Any legal suit, action, or proceeding arising out of or related to this Agreement shall be instituted exclusively in the federal courts of the United States or the courts of the State of Texas, and I waive any and all objections to the exercise of jurisdiction over me by such courts.

Acknowledgment:
I have carefully read this Agreement, fully understand its contents, and sign it voluntarily. I understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this Agreement freely and voluntarily, and intend by my signature for this to be a complete and unconditional release of liability to the greatest extent allowed by law.

PAYMENT TERMS

No sign-up fees.
Your membership starts on the day you sign this form and will be prorated for the remainder of the month.
Your monthly billing date will be on the 1st of each month. Your dues will be automatically charged to your card or checking account on file on the 1st of each month.
You may put your membership on hold as needed or as personal circumstances require you to do so. Life Happens, we get it.
Cancel any time. Just tell us why and how we can improve. You may be required to buy Marie a dozen donuts.

EQUIPMENT POLICY

No member or visitor is required to purchase any equipment from Dino Jiu Jitsu.
All members are required to wear clean, sanitized, and proper attire for the perspective training class.
Members with their own Gi are encouraged to purchase a Dino Jiu Jitsu patch, but not required. You would be a lot cooler if you did.
Members / Visitors without a Gi can borrow a loaner on a class by class basis for up to one week subject to availability.
Members / Visitors will not be allowed to borrow or loan rash guards from Dino Jiu Jitsu. Feel free to ask a fellow student though.
Mouth guards are a really good idea. Dentist work aint cheap.

PAYMENT AUTHORIZATION

I authorize Dino Jiu Jitsu to charge my credit card for monthly dues and any past due amounts on my account. This authorization is as valid as a physical signature.
